Good pm,Guys, I need your help.. Let me tell you a brief story of my problem.
Almost 6 years ago(december 2007), my mother died because of kidney failure. She was then a member of cooperative that provides loan. When she died they told me to give them my mom's passbook and a death certificate. So I gave it to them. As far as I remember I surrender the passbook and Death certificate january 2008. Since that year we never heard any from them but apparently(June 2013) they went to our house and inviting us to settle payments with interest of 5years amounting P80K without any legal notice since my mom died. I want to know the law about deceased members of a cooperative with unfinished loans. The cooperative's collector keeps on texting me threatening me that they will go after my mom's co-makers.

The obligation to pay the loan for the reason that the maker or co-maker is dead, is not transmissible to the heirs simply because it is personal in nature. The liability will be shifted to other CO-Makers.

Unless, that "other" co-makers are the heirs of the deceased maker, wherein, such obligation to pay arised by reason of that contract.

The creditors can go after the estate of your mother. Mababawasan ang mana mo. But the creditors cannot go after the heirs' own property..unless co-signer yung heir sa utang.
