Meron kami deed of sale of undivided property, nakapangalan ang deed of sale sa parents ko, binenta ng one of the owners ang part niya sa parents ko. Ang mother title is composed of 170.5 sqm, and lima ang original na may-ari nito. So ang nasa deed of sale lang 34.10sqm (170.50sqm /5 owners = 34.10sqm per owner), wala pang technical description yung part namin, and we'll process the survey of the land this week.

Aware napo ako sa mga capital gain tax, documentary stamp etc..

Ang hindi ko nalang po alam is magkano at ano ang babayaran para mapagawan na namin ng titulo yung part namin.

i think you already have most of the costs figured out. my question is whether the other co-owners are agreeing to a partition of the property because you will need a deed of partition.

thanks atty. so even of may deed of sale kami, to make it effective, kailangan ng deed of partition which has to be signed by the other co owners?

what if hindi sila pumayag pumirma sa deed of partition? what can we do?

and paano po kaya yung content ng deed of partition, wala pa pong technical description yung part namin e. pwede rin po bang i describe as "one-fifth of the whole property" lang muna nakalagay?

if they don't agree, you will have to file a case to enforce partition.

the deed has to have the tech description. talk to the co-owners first to determine which part will be yours then do the survey.

Paano po pala kung namatay na ung isa sa mga owner?Sino po ung pipirma sa deed of partition sa part ng namatay na owner?Kailangan po bang pumirma ng lahat ng anak ng dead owner or a representative of the family of the dead owner will do?

lawrence, the by the book answer is that you will have to settle the estate of the dead co-owner so that his share can be transferred to the spouse and/or children and then all of them will have to sign a deed unless they can issue an SPA to authorize someone in behalf of them
