Hi,

Just want to politely ask some legal advice.

I was informed by my husband that he's already filing for an annulment. He's working abroad as an OFW right now. When I inquired what type of annulment was he filing, he said both nullity of marriage and annulment of marriage. The reason that he filed was "psychological incapacity" to both of us. Chances are he would not be able to attend the hearings as he's working abroad. Also he filed for the sole custody of our 15 year old daughter.

My questions now are:

1. If the result would be that our marriage will be annulled, will it be printed in some newspapers. I was told it will show in newsprint, is this true?
2. What are the chances of having our marriage annulled if I didn't show up, meaning I won't contest the charges anymore.
3. I have no idea about this but how much is to hire for a family lawyer? Or how much would I need to spend to contest an annulment case, all in all?
4. How long does it takes for a marriage to be annulled/void?

Thank you so much for whatever legal advice you can give me.

1) possible if you cannot be found in the address he provides
2) still possible
3) it depends on which lawyer you retain, but in our office, we don't charge as much when we oppose an annulment.
4) at least a year

So my understanding to your reply in no. 1 is that if I don't contest but received the notice the ruling would not be printed in any newsprint or media.

If that is so then I'll decide which way to go once I receive the notice, according to him the psychological incapacity ground that he filed applies to the both of us.

that's correct, but it's not up to you. if he alleges a correct address and you refuse to accept, you will be deemed as having accepted it.
