Adultery case inquiry

Hi, i was able to recover pics ng wife ko with her alleged boyfriend. some of the pics is on the bed and my wife is wearing nighties and ung guy walang damit pang taas. ung ibang pic naman nagki kiss. would that be enough para gamitin evidence? minsan din nagtalo kami ng wife ko and bigla nya sinabi sa kin na hindi ko anak ung 2nd child namin. cguro dahil sa sobrang galit nya. san ba ko pwede magpa dna dito sa pinas na pwede gamitin as court evidence? if ever makita sa result na hindi ko nga anak ung 2nd sure conviction na ba un? ilang years na kulong ba ang audltery? if convicted will i get full custody of our first child?

You can have a DNA test in ST. LUKE'S GLOBAL CITY TAGUIG. Its worth 50,000. And yes if the dna test is negative it is a sure evidence in court and 6nkt more than 6 years ang kulong and yes the full custody of your child will be yours pag nakulong asawa mo.

if that happens do i need to file a petition for annulment as well? (of course nobody wants to be tied up sa ganung klaseng marriage forever) as what i know dapat may grounds for annulment, right?

Korek, wag mo an hintayin pa ang DNA result, mag file ka an ng annulment Kung Hindi an kayo magkasundo. U need to speak to an attorney. If proven that she's messing around u will still get the full custody. Goodluck.

Unfortunately, hindi lang sarili mong anak ang makukuha mo for full custody! kundi pati ang anak nya sa ibang lalaki dahil kasal sya sa iyo! So if I were you set her free to take full responsibility of her child with other man! otherwise if you intend to send her to jail! You will take the full custody of her child to other man and you are not allowed to treat them differently with your own child as we now have "Bantay Bata" in which you can be sent to prison if you abuse her child!

actually i dont mind taking care of the other child dahil 2 years ko ng nakasama un eh, napamahal na sa kin pati sa family ko and also in good terms kami ng parents ng wife ko dahil aware sila sa mga ginagawa nya and hndi nila tino tolerate.. habang lumalaki dun na ko nagkaron ng doubt na anak ko ung 2nd dahil sa eye color and hair type which is similar dun sa guy na nasa pictures na nakuha ko..

May i know kung pano ba ko makakapagsampa ng kaso? do i need to consult with a lawyer first and have them do the paperworks or pwede ba ako na magsampa ng reklamo like fill up a form and then saka kumuha ng lawyer? 90% decided na ko to file a case and also nag effort na ko sa pag collect ng information and to print ung mga pictures na evidence para ma attach sa complaint ko.
Also, correct me if im wrong if i file a case and my wife decides na makipag ayos. would that even be possible?

if i were your lawyer, i would advise you to try to get your wife to agree to conduct a dna test. it is best if both of you and the child give biological sample because the result will be more accurate.

then when you get the result, only then file a complaint for adultery

those pics will not be sufficient evidence.

what are my options if she declines? if she knows the truth syempre she will try to hide it if mapapahamak sya diba..

if you can bring the child by yourself then the dna test can be still done.

adultery is punished by up to 6 years. our probation law allows the accused to seek probation to avoid jail.

Probationary ang Adultery..Kahit masentensyahan yan, kapag di lumampas ng 6 years of imprisonment ang hatol mag aaply lng yan ng probation. Ibig sabihin mag rereport lng yan isang beses sa isang buwan sa probation officer. Depende sa kundisyon ng probation kung ilang taon..Kadalasan 3 years. Sa akin, Nasa full custody ko ang anak namin., yun lng ang kalamangan ko at panalo ko., COnvicted sila kahit nakapag probation..At ang sabi ng atty ko. Hindi nya pwedeng kunin ang bata sa akin dahil convicted sila sa kasong Adultery...Lalo na babae anak ko..Nakalagay pa sa probation condition nila na hindi sila pwedeng lumapit sa akin sa loob ng 500 meter...Kapag nilabag nila maari ko ipa revoke ang probation nila kapag lumapit sila sa akin sa loob ng 500 meter. Kaya di nila pwedeng kunin anak ko sa poder ko hanggang ngayon..Yan ang nangyari sa kaso ko.

Di ko alam sa NBI. alam mo naman ngayon pag nilagayan mo jan sa NBI cleared na ang Clearance mo. Sa DOJ tiyak may record sila. May mga company na ngayon na pinapakuha ang isang tao ng DOJ clearance kaysa NBI.

Pwede ko ba malaman kung hangang kelan effectivity nung order na hindi sila pwede lumapit sayo within 500 meters? will it end after the probation ends?
gaano katagal inabot ng case?
and pag nasampahan na ba sila ng case pwede ba mag pyansa?
