Atty. pregnant po ako ng 2months at hindi po maganda ang health condition ko nito. Umabsent po ako ng company for 10 days at nagnotify naman ako sa kalagayan pero atty. kulang po ang naipakita ko na medical certificate ko dahil po wala ang OB na tumitingin sa akin. 7days po ang kulang sa medical certification ko, tinerminate po ako ng company dahil sa kulang ang naipakita ko. Tama po ba un kahit na meron po akong notification sa kanila ng absent ko at alam naman po ng company na dumaan po sa critical condition ang baby nung 1month of pregnancy ko?

i recommend that you go back to your ob-gyne and then ask for the certification which you lacked, and then give a copy to your company and ask for reconsideration.

if they won't reinstated you, your recourse will be to file a complaint at nlrc. the medical certificates will be very important evidence.

atty. nagbalik nga po ako sa clinic na un pero hindi po nila ako mabibigyan ng medical certificate dahil nung mga araw na un wala po silang clinic. Ang nakuha ko lang po ay certification na wala xa nung araw na pumunta ako, atty. holiday season po kasi nung mga panahon na ito. Pero hindi pa rin po ako binigyan ng company ng kahit konsiderasyon since alam po nila ang naging kalagayan ko. Ano po ang dapat kong gawin?

talk to the OB gyn who examined you to make some kind of written statement. you claim that you did not have a good health condition that time and you will need her or some other doctor to attest to that, and that the your absence for ten days was justified.

otherwise, if this was 25 december until after new year, there are so many employees who goof off at that time, and it is your burden to prove that your absence was justified.

Good evening po Atty.

I have a brother who was working in a gasoline station. Nakasuhan ang 14 pump attendants of the gasoline station kasama ang brother ko ng qualified theft. May isa kasing kasama nila na nahuli raw through CCTV camera na minamaniobra ang calibration. Tapos, dinamay silang lahat. Ang ginawang disciplinary action ng company is tinerminate silang lahat at hin-old ang kanilang salary and 13th month involuntarily. Pagdating ng subpoena ay ng file kami ng counter affidavit. My brother is not guilty of what their accusing him kaya we really fight for it. Ang tanong ko lng po, ano po ang mga procedures na dapat naming gawin and in case matalo kami sa kaso, ano po ang mga maaaring mangayari?...HOw much would be the bail in case po..? Yun po ang kinakatakot namin kung may warrant na.

ask ko lang po. meron po kasi akong unsettled card before, nabayaran ko na din po cya.. then nag aapply po ako sa isang bank as an officer, nainterview na po ako up to VP... problem ko po may effect po ba ung bad record ko sa employment?
