sir, tanong ko lang po.

paragraph 5 sa aming contrata nakasaad doon na "5. you agree to accept assignment to any location, if and when requested by the Company."

upon closure of my branch i was assigned to the branch next to our city. but due to some problems napapunta po ako sa dole para i report yung employeer ko.

sa ngayon tahimok na ako sa place na binigay sa akon dahil di naman gaano kalayo sa lugar namin. pero one day napatawag yung regional head ng company and told me that she well be reassigning me to a very far place. tinanung ko sya kung bakit ako, of all the employees in mindanao bakit ako pa. meron nman sguro staying malapit lang sa lugar na yun. and i also ask her if meron ba sila problema sa akin.

sabi nya wala daw sya problema sa akin. pero yan tinanung ko pa sya kasi gusto ko malaman bakit ako. (kasi syempre ayoko ma transfer sa lugar na malayo kasi its risky. we are a moneyshop, kwarta padala, single post, no security guard)kung i assign ako sa lugar na maraming rebelde syempre i would ask why.
the she told me na meron daw ako attitude problem. kasi daw noon pina pa dole ko sila while we are still in the middle of solving the problem. (middle of solving the problem, sabi ng HO na wala na sila paki alam sa problema namin, sya naman sabi nya salary deduction daw sa akin, yun ba yung middle?) i was judt asking for their presence sa dole para maagkaliwanagan kami. attitude problem ba yon?

sa ngayon di ko alam kung tama o hindi, kasi yun na nga they have planned to transfer area in misamis occidental.

makatarungan po ba to? dahil nga sa contrata namin? kasi sa nakita ko mukhang theyre trying na iassign ako don dahil nga s arason na napa DOLE ko sila noon.

help po sir di ko alam gagawin ko

That provision of the employment contract is valid. it is a valid exercise of management prerogative to transfer you to another post without downgrading your position as well as those benefits already granted, PROVIDED that the transfer is done in good faith.

Dito tayo magaaway sa term na "GOOD FaITH", if the sole reason of the company is because of your alleged "attitude problem" then that transfer is not done in good faith, why transfer you to another place when the company can impose sanctions to you by reason of your attitude problem, dba? gets mo yung logic?. So you can question that again sa DOLE invoking that "GOODFAITH" in transfering your undertaking.

yan na nga po sir, 1st reason po nya is that the branch in one area closed at ito pong area ko yung pinakamalapit thats why she is transferring the processor the the said closed branch here. tanong ko sa kanya bakit, reason nya lang is babae daw yung kaya dito nya i-a assign. i asked her why here, why me, nananahimik na ako dito sa branch ko, yan lang ba talaga ang rason or is there another reason why ako yung napili nya i transfer sa medyo delekadong lugar (far place, money transfer nature of business without a security and single post. sabi ko baka meron pa ibang problema, o baka namat yung isa nyang alaga yung nagpapaasign sa akin don. don na po sya nagalit ang she said i have attitude problem. (matatawag mo bang attitude problem if you question there decision? attitude prblem ba kung di ko alam paano maging sipsip sa kanya?) Lumabas din sa kanyang bibig ang tungkol don sa nangyari nung october kung saan pinapatawag ko siya sa Dole. well, for me possible naman talaga na yan yung rason kung bakit nya ako iaasign sa malayung lugar. kasi nga napatawag ko sila sa dole for making a decision without studying the case happened. was that my fault? all i know is i just did what i think is right. everyone deserve due process. kay regional head ka man at akoy isang ordinaryong empleyado lamang, di ba sa mata ng batas patas lang kami. and i have the right to question her decision if sa palagay ko mali naman talaga sya. we are all professionals thats why gusto ko lang sana she will behave like one.

the presumption is that it is a valid transfer. you have the burden to prove that it is being done in bad faith
