if an employee was given final warnings and was terminated without being informed that they should come with a legal counsel on the hearings conducted, does that violate the employee's rights?

the notice for hearing should state that the employee has the right to come to the hearing with or without a counsel..

if it was not written.. then there could be a technicality.. but still the notice of hearing was followed..
