Yung Revised Penal COde natin, merong tinatawag na Detention Period, within which, within that period(time), the complainant should file necessary complaints(irregular file kasi mabilisan to, time is of the essence) before the fiscals office, otherwise, paglumampas na yung period, i release na yung suspect, and your remedy is to file a criminal complaint sa fiscals office(regular file)

Below are the Detention periods within which the complainant SHOULD file a case.
1. twelve (12) hours, for crimes or offenses punishable by light penalties,
2. eighteen (18) hours, for crimes or offenses punishable by correctional penalties,
3. thirty-six (36) hours, for crimes or offenses punishable by afflictive or capital penalties.

So, kailan to magstart?, the moment na naarresto yung suspect, it presuppose na yung arrest is without warrant of arrest., usually, mangyari lang to kung IMMEDIATELY the suspect commits the crime and nahuli sya agad-agad. In your case, the crime was commited last Dec.3., so kung nalocate sya Dec. 8, then yung "detention period" di na magapply.(Eto yung sabi nilang "panis")

Since nalocate sya DEC. 8, the best thing to do is to file a criminal complaint sa fiscals office(regular file)and an application for warrant of arrest or search warrant to that effect, usually the police SHALL resort to this kasi paghinuli yung suspect(Last Dec.8 ) and kinulong without WARRANT, liable na ang mga pulis. mga pulis na ang kakasohan ng suspect. How ironic our law dba?

After ma arrest, makulong yung suspect unless maka pyansa(Bail bond). Then the case continues...

pero kuya, ung pagnanakaw ay committed in his presence... diba pupwede na kapag nakita niya yung magnanakaw ay arestuhin din nya ito in ur face?

I believed that the crime was not commited in his presence, but he knew that there was a crime commited when his tablet was gone. Otherwise, he can do citizens arrest immediately. why wasting time to do some blotters, when you can file a criminal comlaint immediately within the detention period.

e2 naman ang ngyari sqn may connection din sa mga pulis.. the incident happened december 11, 2012.asked aq ng help sa pulis kasi may brgy kagawad na lasing at may dalang gulok nahumarang sa anak ko habang naglalakad pauwi ng aming bahay at hinamon ng away.at tinapatan ang aking bahay ng 2 beses.nong ikalawang balik humingi ako ng assistance sa pulis.sa dami ng tanong, sa bagal tumayo (kasalukuyang nanonood ng tv ng dating ko)kaya naman di na inabutan ang ngwawalang brgy kagawad sa harapan ng bhay ko aside from the fact na kamaganak pla ng nasabing pulis ang brgy kgd nangwawala. may ngsuggest kung bkit daw di sundan sa bahay ung brgy kgd at kauuwi lang ang sagot ng pulis "hindi pwede at bawal"
After ng blotter ko tinanong q ang desk officer na humarap sqn kung kelan kami pwedeng magharap at mag-uusap ng taong pinablotter q..ang sagot ng makisig na pulis " kapag magkasama na kayong 2 na pumunta dito sa istasyon"

what if my cctv video fotage po on january 30 20013 case thef then nahuli sila for atempting to pick poket on feb 4 2013 then found out my records cla cctv for theft on jan 30 2013 kinuha nila bike worth 9000 can they still detain in sub precint to inquest proceeding?or still release and regular filing?

do not confuse filing a case of theft with a warrantless arrest.

the warrantless arrest is not proper because of the time lapse. a complaint has to be filed at the prosecutor's office. if the prosecutor files the case in court after preliminary investigation, then the court will issue a warrant for the arrest of the accused.
