i want to have my share.....

we signed an spa, me representing my late father, my cousin representing his late mother, and one of our uncle signed also, that said spa is given to one of the surviving heir of my late grandfather who owned a titled property, granting our uncle to be our atty.-in-fact in selling the said property, thus when this property is sold it will be divided into 4 equal parts less the expenses in selling the property, so he sold that property and i didn't receive my share and i seek help to the barangay but he refuses to give my share. is it possible that i can sue him with estafa? thank you and good day.
