Arresto Menor

I and my siblings inherited a property from our deceased parents. The title is still under our father and hasn't been transferred to our names as heirs yet. If we decide to partition the said property, what are the steps that we should take? Can we transfer the title with partition to each of us?

If you are the only child, (never mind your siblings, because thats your parent's property) just execute an affidavit of self adjudication to transfer the title to yourself.

If you have brothers or sisters, you can EITHER execute for :

1. Judicial partition - the partition will be conducted by the court.

2. Extra-judicial partition - the partition will be conducted by the lawyer.

Ofcourse, there are some additional payments like estate tax, doc tax, etc.
