Hi,

My mother's (deceased) land property is sold and paid in full already by the buyer. There are five heirs to this property. My father as surviving spouse, myself and my 3 other siblings. They already received all of their monetary share in full. One of my siblings even already bought a new car using her share. While mine still sits in my sister's bank account. Despite my calls and query over the phone, my other sister keep on finding excuses that she haven't had time transferring my money to my bank account. I already gave her my account number. All she has to do is to make the deposit. The last conversation we had was yesterday and she dropped my call in the middle of our conversation. Sensing that she really has no intention of doing so, what necessary legal steps can I seek to get my share? Hope someone can answer my question and many thanks in advance.

Inform your father and all of your siblings about this. They could help you settle this out within your family. Pag-usapan muna ninyo within your family before you go out and find remedy without consulting your father. Ang gusot ng isang pamilya nareremedyuhan naman pag napapag usapan.

Good day Atty. Yes I did inform all of them. The hard part was my father and my sister who has my share lives on the same house. I also called up my father. Binabaan din ako ng telepono. That's why I couldn't help but be suspicious on to what their real intention was.I am still giving them time to comply. I have been working here in manila for 8 years. While all of them is in the province. I am always the last person to know what deals they have made with my mother's estate. Thanks for your advice. I still hope my suspicions are wrong.

ganyan din ang problema ng kaibigan ko. ang ginawa niya kinasuhan niya yung tatay at ate niya. sa awa ng diyos, kahapon tumawag siya sa akin kung pwede ba iurong ang kaso kasi napapagod na daw siya ng pagpunta sa probinsya sa kaka atend ng hearing at kabibigay ng appearance fee sa abogado...sa 100 thou na claim niya (ang share niya sa lupa) ang acceptance fee daw ng lawyer is 25 thou at may appearance fee na 1,000 every hearing, galit pa daw sa kanya iba niya kapatid at hindi siya maka atend ng reunion ng family. by the way, 15 years ago na niya ipina file ang kaso...
