Arresto Menor

Meron po akong smoker na guy officemate. Ako lang po mag-isa sa airconditioned room. Minsan pong dumaan sya sa harap ng table ko ay sinabihan ko po sya na "Mister, ang sigarilyo mo," dahil po masakit sa dibdib ang nalalanghap ko na usok ng sigarilyo nya. Lumabas po sya sa opisina at isinara ang pintuan ngunit nagulat po ako ng biglang bumukas ulit ang pinto at nanggagalaiti po ang kanyang boses, as in full volume po, na nagmumura para marinig ng lahat na nasa labas. Ang sinabi po nya ay ganito: "Hijodeputa kang lintik ka! Parang donya ka kung makaasta ka dito sa opisina!" Sinagot ko lang po sya na "sinasaway lang naman kita dahil sa usok ng sigarilyo mo!" Ilang beses pa po nyang inulit ang mga mura nya na yon at pati ang manager namin ay narinig lahat ng sinabi nya. Inakbayan lang po sya ng manager namin palabas na parang pinapatigil po sya. Two days after po ay kinausap ko ang manager namin na gusto ko pong ireklamo ang officemate na yon. Ang sinabi lng po ng manager namin ay paghaharapin kaming dalawa at kung hindi kami maareglo na dalawa ay bahala na raw kami. Ano po ang dapat kong gawin? Nasa consumer-services po kami at may nakarinig din pong mga consumer during that time na ginawa nya yon at natatakot po ako na baka ulitin nya ang ginawa nya.

Well im glad that your Boss is doing his part to settle the issue between you and the untame smoker who embarass you, yan kase pag nangyari sa loob ng workplace company rules and regulation should take precedence first. if you want you can file a complaint to the Barangay where your place of work is located..kase this is mandatory on the other hand it will spare you from incurring litigation expenses,,so stand by your right but need to consider a lot of things.

the barangay will be relevant only if you both live in the same municipality or city.

refer to your company's rules on conduct whether his acts can be considered an offense.

you can also consider filing a criminal complaint for oral defamation or unjust vexation at the prosecutor's office.

Katarungang Pambarangay is not adversarial in character rigid rules should be relax. the parties being resident of same city or municipality is the general rule EXCEPT, when both parties agreed to settle their despute amicably. as I said, job related despute dapat mag file ng complaint sa barangay na nakakasakop sa Company na pinagtatrabahuhan nyong dalawa. drop the requirement of residence here kung walang mangyari then file ka ng unjust vexation lang it also includes civil liability sa piskalya
