I worked for my previous company for almost 8 months. Nagresign ako this November 7, 2012. I started working with the company last February 13, 2012. When discussing my back pay with the HR manager, she told me na may kulang daw akong more Php 6,000 sa tax and they will just deduct it from my back pay. Question lang po, kapag di natapos yung buong fiscal year for filling of tax, di ba dapat makukuha ko lahat ng tax na nabawas sakin??

mali ho mam. kasi iyong na deduct sa iyo ng employer mo, ni remit na iyon ng employer mo sa gobyerno iyon mam. dapat bayaran mo kasi iyon. income tax liability mo iyon mam. dapat mo bayaran iyon talaga. pero ang employer mo, ginawang agent ng gobyerno. withholding tax agent ng govt ang employer mo para masee to it na ang mga income tax ng mga employee maremit sa govt. if remiss o pabaya ang employer mo sa pagdeduct ng tamang tax sa iyo, sila ang hahabulin ng govt. kaya nagiging istrikto ang employer mo sa pagwithhold ng tax sa iyo kasi if nagkamali sila or nakulang ang tax na dapat i withhold sau, sila ang hahabulin ng govt. kaya tama ang ginawa ng employer mo na i see to it na bago ka magresign, tama ang tax na withhold sau. me annual readjustment na kasi iyan sa payroll at the end of the month of oct or early november to see to it na matama or ma adjust ang tamang tax sau.

so , sa mga na withhold na sa iyo na income tax, di mo iyon makuha kasi naremit na sa government iyon at saka babayaran mo talaga iyon month.

sa 6,000 na kulang mo, justified iyan sila na ibawas iyan sa marerecieve mo pa na amount. kasi pag i audit sila ng bir niyan, sila ang hahabulin niyan sa remaining amount na iyan. kaya bakit pa sila magbayad sa tax na personal liability mo na puwede naman ideduct iyan sa amount na marereceive mo pa sa kanila.

pero ang ginamean ko lang mam is ang income tax liability lang sa sweldo mo from feb to november 7, 2012 mo mam. hindi ho kasali iyong income tax liability mo from november 8, 2012 to december 31, 2012 kasi wala ka namang salary jan.

so ang ginawa nila, kinuha nila ang annual income mo from feb to november 7, 2012, dineduct nila ang personal at additional exemption mo, at doon nila nabase ang annual income tax mo sa net income mo. kung ano ang tax due mo at ano na ang nadeduct na withholding tax sau, iyon ang balance na babayaran mo pa sa government. iyan ang puwede i minus sa iyo

pero iba ang usapan if before ka nag resign , nakahanap ka ng bagong work at nagwork ka sa november at december 2012. in that case, form 2316 lang ang i issue sa iyo ng previous employer at kung ano man ang kulang, sa new employer na ang magdeduct niyan. magreadjust iyan para mahabol ang november at december. so kung ano ang kulang , jan madeduct sa november at december mo na salary sa new employer mo.

I rendered my resignation letter 2 months before the effectivity date of aug 30,2012. I worked in that company since may 2010. Until now, they havent released my backpay. ive been following it up but they explained that it is still for recomputation. i am still not working.
Question:
1. Should i receive tax refund?
2. Can i take legal actions because of the delay in the release.of my backpay?
