Grave threat

Atty. goodeve can i ask some advice about my case?.. nov 1 2012 we have a drinking spree at my street in davao and also have a bday party , my neighbor i greet him then suddenly his drunk brother in law go to our table (my property) he sit and i accomodate him as a friend because he is the brother in law of my neighbor suddenly despite of being boasfull he punched me but i didnt (patol) and i pacify the commotion and after a minute he started to mocked me and result to a fist fight because of hambog na po sya then he throw some glass with full of beer in my face. binugbug ko na po sya as a self defense , suddenly my neighbor saw the incident because all of my friends inawat na po ako pinasok na po ako sa bahay ko para wala nang gulo ,then my neighbor diniskitahan nya ung girlfriend ko sinapak nya tska inuntog sa truck naka park doon sa amin banda. pumalag ako then sinuntok ko din sya kasi parang sa akin i will rescue my girlfriend tska bakit pumatol sa ng babae eh lalake sya at di nya alam kung anong talagang nanyari between sa bayaw nya at ako. parang nakita nya dihado sya sa suntokan namin dalawa kumuha sya ng baril tska tinutok sa akin agad naman po ako umalis pumasok sa bahay namin.. dahil takot na takot na ung girlfriend ko na may injured din tumawag na kami ng pulis. and the neighbor ko na may baril nag sabi sa amin na "lumabas ka at papatayin kita mawala ka na dito sa mundo" then gi blotter ko po ung nanyari. question atty ano po ung advice nyo po about this grave threat case na ito? may laban po ba tau dito? kasi may medico legal kami tska witness sa threat nanyari and then yung mga pulis may nakitang live bullet sa gate ng bahay ko na mismong ebidensya at match sa baril nya nung bala at pina endorse ko din dun sa pulis..

after undergoing bgy proceedings, you and your witnesses should prepare complaint affidavits and file a complaint at the prosecutor's office.

ok atty.. how about if the suspect are not appear?.. should i demand cert. to file action?

ah ok atty so approx. po 15 days po daw bago ma process and cert. to file action.. after that ba atty diretso na po ako sa fiscal?

atty . we end our 1st hearing of lupon ng tagpapayapa. he appear but i told the lupon and the other assiociates of lupon that i decided not to motion of amicable settlement. but he insist me if the accuse to paid me what damage have cost but i tell them that he voilate the bill of rights and the law as well. my question is is it possible he file the counter affidavit against me? kasi parang nag baligtad pa ung mga salita nya but i have deeply evidence na he took the gun on me and extract the bullet at my home.

bgy is precisely for settlement. at least try to listen to the offer otherwise it will be stated that you were the one who refused to negotiate

indeed, brgy is for settlement, but if you want to pursue your case no one's stopping you to do so. just get a copy of the cert to file action from the brgy then file your complaint with the fiscal's office

now i know... so atty cn you give me some legl tips how to pursuAde the suspect i mean if i file a case against him gsto ko po mag bigay sya ng danyos as a moral damage na ginawa nya..can you give me some tips para mag bigay sya?

well for me gusto ko makulong un sya.. pero.. sa akin lng is gusto din namin mag bayad sa ginawa nya.. sa akin lng po ba mas maganda ma pursue ang kaso para din bgyan sya ng babala na di pwede gumawa sya ng katarantaduhan ..baka kasi gawin pa nya sa iba.. so sa inyo ba ano po ba best gawin sa kaso ko?

ah ok po... kasi pina patagal ung cert. to file action eh... ang tagal kaya ng sixty days because i have the affidavit of complaint na ..pinagawa ko sa lawyer ko para diretso na po ako sa prosecutor.. pero cert. to file action na lng wala.. paano ko ma convince ang barangay para makuha ko na ung cert. to file action?.. tska di ako natatakot kasi alam ko dito sa DAVAO CITY ang mga abusado na citizen pinakukulong at walang kapatawaran ginawa nya kaya kampante ako. kung ayaw ka bigyan ng CFA sabihin mo magdadala k ngmedia.. gniun talaga sa BRGY e panget kasi, obstruction sila sa batas.. kala mo naman may alam sa batas.. pinapaikot ka lang nila jan

yah i know .. but i pursue the case no matter what ...last day i send my letter from my private lawyer to request my certification to file action kung hndi ang lawyer na bahala sa kanila kung aasuntuhin ba sila

yes actually pwede kasuhan ang brgy.ng administrative case.. kasi kung ayaw mo paareglo... kasi kaya lng naman maybrgy, if kayang maareglo sa brgy, bkit pa papafiscal..

galingan mo... dapat daw 30days lang angcasesa brgy.. pwede k din mag request na derecho na sa brgy captain ang imbestigasyon.. para pirma na CFA

yah... but in our law is 60 days they follow the rules.. and i read the rules which is true 60 days.. it depends naman sa pag request mo eh..para walang technicality between both parties.. sabagay walang expiration naman ang kaso basta reliable ang probable ung case mo

sabi nong chairman 6 mos ang expirationg CFA.. galingan mo ha.. dapat matutunan ng leksyon ang mga mayayabang na katulad ng taong kalaban mo.. HINDI LAHATNG KULOT SALOT... yung iba hindi Kulot pero kung umasta SALOT!!!
