Arresto Menor

Atty. nakatanggap po kami ng subpoena
galing NBI at kami ay nagharap ng nag
aakusa sa amin ng libel at gravethreat
sa NBI dahil lang po sa maling pagbi-
bintang sa FACEBOOK. Inalispusta,
nilait at hinarass po kami ng nag aa-
kusa. At sinabi po ng NBI na nirecomend
po sila (nag aakusa) na magfile ng
kaso laban sa amin sa DOJ. Maari po
ba silang mag file ng kasong libel at
gravethreat ng hindi dumadaan sa baranggay.

At isa pa po un kasama ko po inaakusahan
ay hindi nya kilala o nakita mang lang sa
personal un nag aakusa ngunit sya ay pina-
dalan ng subpina ng NBI. Pwede po ba mag
demanda ng directo sa prosecutor office
un inosente kasama ko dahil ni minsan po
hindi sila nagkita ng taong nag aakusa sa
kanya. may laban po ba kami dahil lang
maling pagbibintang anong kaso po ang pwede
naming isampa. Kung halimbawa po may demanda
a sila galig DOJ tulad ng sinasabi nila
pwede po ba kami mag demanda rin ng libel
gravethreat at incriminating innosent
person dahil sabi po ng iba wala daw po
counter charge ang criminal case na libel
gravethreat at incriminating innosent person.
kaya dapat daw po unahan namin. Pwede po
silang mag demanda sa DOJ. kami po pwede ba
mag sampa ng kaso magkano po ang pagsampa
ng kaso directo sa prosecutor. Maraming salamat
po atty sa mga naitutulong at paliwanag nyo
sa amin.

yes, they can file directly at DOJ, but note the NBI is not doing it for them. this tells me that the nbi doesn't believe there's sufficient evidence. they don't have to file first at bgy because grave threat and libel are not within jurisdiction of bgy.

yes, your EX can file criminal charges also. what happened to their claim of adultery?

there's no rule that a counter charge has to correspond to the original charge. they will just be consolidated because they are related.
