Gud am.. need your advice po. My mother purchased a land using her maiden name since she and my father do not have communication and my father lives with her mistress during that time, now we are planning to sold the land. i just want to ask if my mother can sell the property without my father's approval or they have to agree on it? pno po ung hatian should it be 50/50 though it was my mother who financed almost all of the expenses in building the house.

if your mother and father are still married and they have not undergone judicial proceedings to separate their properties then technically the property is theirs both.

i do not recommend this. if on the title of the property it states your mother is single and she is the sole owner, then the registry of deeds cannot challenge the sale. note however, if your father finds out and wants his share, he can make a lot of trouble for your mom and the buyer. is he that thick-faced?

super po, he and my mom never got along ever since, wonder why no one gave up on the relationship.. he's been verbally abusing her. the thing is, we want him out of our life but of course he won't go unless he had gotten something. just want to know where my mother stands in this case. in case, okay lan ba gwa kme ng ksultan that after he has gotten his part of the money,he can no longer see or talk to my mom?

so he and your mom still communicate till now? if you were to sell the property, you know how to contact your dad to have him sign a deed of sale?

you may explore the option of filing a case for legal separation by your mom. your father may be deemed the guilty party and all their properties adjudged to your mother.
