Hi, just some inquiry about AWOL cases. I have an employee who resigned and does not report to work immediately after filing her resignation, does not serve the 14 day retention period we demand (we only demand 14 days, though i heard the law requires 30 days). Then after few days she filed a complain in dole for underwage issue. (She worked for the company for almost a year, contractual, and yes we were not able to give her a minimum wage) Dole cases are really hassle to business like us. I want to seek advice as to what can we do about it. Is it wiser to settle and just demand for damages due to abandonment of position?

Also, there are some company documents she failed to turn over to the company before leaving, she also has pending loans and other depts in and outside the company. CAn we use this against her? how? Thanks.

moderator

you made yourself vulnerable by not paying minimum wage. you can indeed seek damages but you have to prove your entitlement. only loans to the employer can be deducted to your payment to her.
