Good Day Atty,
here are some facts about my family:
-my parents are first cousins
-ang mga nanay nila ay magkapatid; ang mga tatay nila ay hapon
-ang mga lola ko ay galing sa mahirap na pamilya sa ilocos sur
-elementary lang ang natapos at dito na sa maynila nagdalaga
-hindi daw sila mga comfort women dahil nameet nila ang mga lolo namin before the war
-my parents were both born on the year 1941 (war babies)
-pinatawag ang mga lolo ko sa japan at pagbalik dito e mga sundalo na sila
-ung lolo ko (takechi uehara) sa fatherside ay walang iniwang docs sa asawa nya
-ung lolo ko (tokufu omine) naman sa motherside e iniwan ung japanese passport nya and some family pictures and naiparegister nya sa japan ang nanay ko
-na-assign ang mga lolo ko sa magkakaibang probinsya at parehong hindi na nakabalik
-hindi ginamit ng mga lola ko ang mga surnames nung mga lolo ko
-ung tatay ko ginamit nya as middle name ung uehara sa mga school records, passport & other docs nya (ANTONIO U. BITENG)
-ung nanay ko hindi nya talaga ginamit instead she uses the surname nung kalive-in nung lola ko (LILIA B. DEL ROSARIO)
-ang reason nila ay natakot ang mga lola ko na baka saktan sila nung mga kababayan natin na galit sa mga hapon
-so ang name ko ay ARISTOTLE R. BITENG di ko nga alam paano naging "R." lang ang DEL ROSARIO e

-gusto sana naming magkakapatid (5 kami, pang-4th ako) makapagtrabaho sa japan
-nagpunta ako sa japanese embassy at nirefer naman nila ako sa isang foundation/association
-since priority ng japan na tanggapin ang mga NIKKEI JIN o may dugong hapon
-so, ayon sa foundation kailangan namin iprove na kami ay may dugong/lahing hapon
-ang unang-unang pinapaayos sa amin nung foundation e yung mga birth certificate nung mga parents ko
-kinuha ng foundation ung mga names & details nung mga lolo ko na hapon
-since may passport & pictuers na iniwan ung lolo ko sa motherside at nairegister pa sya sa japan sya ang prinaioritize nung foundation
-so inuna ko ayusin ung birth cert nung nanay ko
-sa awa ni lord may nakuha ako sa LCR-MANILA na record, kaya lang may mga wrong entries
-kiochang omine ang name nung mother ko, ti omine name nung lolo ko, nagasaki ung birthpalce
-sa isang picture na iniwan nung lolo ko ay may mag-asawang hapon na nasa guam, kapatid nya ata, di ko alam kung sino dun
-may nakasulat sa likod na sulat-hapon except sa word na TOMIKO
-at ito ay tumugma sa nakuhang record sa japan nung foundation, ito daw ang name nung nanay ko
-so nagfile na kami nang change of name/correction of entries
-which was judged last dec. 29 2009 and became final and executory on april 21,2010

-NEXT STEP IS YUNG MARRIAGE CONTRACT NA NUNG PARENTS KO
-dito na PUMASOK ung problema, Atty.
-they were married on oct. 2 1968 sa simbahan sa q.c.
-nakakuha ako nang copy sa simbahan nung marriage cert nila, at nakita ko dun na-incomplete yung pinasa nila na requirements like birth & baptismal certs
-dinuktor din nila ung mga details lalo na ung sa tatay ko, bale kapatid na lalaki nung nanay nya ung nilagay nila as father nya kaya (BITENG)
-ung sa nanay ko naman, middle name ni lola ang ginamit nya na surname (BANGSOY) at ung kalive-in nya na pinoy ang nilagay as father (DEL ROSARIO)
-may nakuha din ako record nung marriage nila sa NSO

QUESTIONS:
1. declaration of nullity of marriage ba ang dapat naming gawin? kasi nga magfirst cousin sila.
2. kapag na approve ba ung petition for nullity, surname na nung mother ko ang gagamitin naming magkakapatid?
3. pwede bang pagsamahin sa iisang petition ung declaration of nullity of marriage (NUNG PARENTS KO) at change name/correction of entries (PARA SA BIRTH CERTIFICATES NAMING MAGKAKAPATID)?? dahil sigurado namang maVOVOID ung marriage nila di ba?
4. are we considered illegitimate? kahit pirmado lahat ung BC namin nung father ko?

nakalimutan ko palang banggitin na patay na po yung father ko nung 1992 pa. pwede pa rin po ba kami magfile nang petition for nullity kahit patay na sya? at gaano po kaya katagal ang pagprocess nung nullity?

Pwede po. The action for declaration of nullity of marriage shall not prescribe. Ang maari pog mag-file ng declaration of nullity of marriage ay ang inyong nanay.

Art. 54. Children conceived or born before the judgment of annulment or absolute nullity of the marriage under Article 36 has become final and executory shall be considered legitimate. Children conceived or born of the subsequent marriage under Article 53 shall likewise be legitimate.

You don't need to file an action for the declaration of nullity of marriage of your parents. In the case of Niñal vs. Bayadog, GR No. 133778, March 14, 2000, the Supreme Court through Justice Ynares-Santiago said:

"Other than for purposes of remarriage, no judicial action is necessary to declare a marriage an absolute nullity. For other purposes, such as but not limited to determination of heirship, legitimacy or illegitimacy of a child, settlement of estate, dissolution of property regime, or a criminal case for that matter, the court may pass upon the validity of marriage even in a suit not directly instituted to question the same so long as it is essential to the determination of the case."

hlslawph has a point here. If your mother does not wish to remarry, there is no need to go through the process of judicial declaration of nullity of marriage.

good day. thank you so much for your advice, hlslawph and attyjoyce. opportunity to work sa japan po kasi ang pinaka main purpose namin dito, so we have to prove to the japanese embassy that we are descendants of a japanese. okay na po yung BCert nung mother ko. LILIA TOMIKO BITENG OMINE na ang nakaregister sa NSO. pano po namin maipapalit ung OMINE sa DEL ROSARIO na nakasulat sa mga BCert naming magkakapatid?

NSO Certificate Correction Of Entry

TEN steps to be undertaken in the correction of an entry in a civil registry document

1 Contact a lawyer who will prepare the Petition for Correction of Entry.
2 Lawyers shall file the Petition in the Regional Trial Court. The fee for filing the Petition in the Regional Trial Court is Php 160.00.
3 The Petition will be raffled and assigned to a branch of the Regional Trial Court.
4 The assigned Regional Trial Court shall issue an Order for the publication of its Order in a newspaper of general circulation for three consecutive weeks. Fee for publication varies.
5 The Order contains the date of the first hearing.
6 During the first hearing, the lawyer will present compliance of the jurisdictional requirements like publication of the Order in a newspaper of general circulation.
7 After establishing compliance with jurisdictional requirements, the petitioner will be presented in Court to testify. The Court may assign the Clerk of Court to receive evidence.
8 During the hearing, i is possible that an oppositor may appear contesting the Petition. If no oppositor appears, the Clerk of Court will receive the petitioner's evidence.
9 After presentation of evidence, the Court will rule on the Petition.
10 If the decision is favorable, the Court will order the Office of Civil Registrar to correct the entry in the civil registry document (birth/marriage/death certificate of the petitioner).

--malamang po e isa sa mga requirements nito ang marriage contract, 'di po ba?
--mukhang hindi na applicable ang Republic Act 9048 sa case namin.
--pasensya na po kung nakukulitan na kayo sa akin at hindi naman po sa nagmamarunong, inaalam ko lang ko lang po kung nasa tamang procedure ba ang ginagawa namin. malaking pera at maraming panahon kasi ang masasayang namin.

good day .. ask ko lang po about republict act 9048 .. panu po kea gagawin namin kulang kami sa requirment BIRTH CERTI .. nf father ko at marriage contract nila mama at papa panu po kea maaus yun? sabi kasi sa imbestigador d daw i process pag kulang may other way pa po ba?? salamat po
