Hi I need help on this. I enrolled my kids on a preschool here. After I paid the tuition for my kids,2 weeks after I was advised that I am obliged to pay the full amount whether or not they finish the school year or not. It was not advised before I paid the tuition. My children then stopped school after 2 weeks of school because of some life threat. The school owner together with the barangay captain went to our house forcing us to pay the full tuition fee on the spot as they had known that the children will not continue school. Since we do not have the money to pay on the spot, the barangay captain and the school owner then went to our house and took our dining set and home theater stating that they will get it to have an assurance that we will pay the tuition fee. Is this act lawful? What can i do about this? I feel that our rights were taken away from us as they took our properties just like that.

Let me qualify my succeeding answers by saying that I am a not a lawyer but a Law Student.

But in my study I have learned that.
1.) Nobody can enter your House of domicile without a search warrant. Even the barangay Captain. In Fact they can be charge with greater charge for violation of domicile(I am not 100 percent sure if this is the correct term but I am sure it is for the Police.) The 3 cases which they can be charge are 1.)If the enter your house without your consent 2.) If you allowed them to enter but they searched your house without your consent. 3.) If after allowing them to enter they refuse to leave when you asked them to.

2.) Only the sheriff upon the order of the court after due process can take possesion of you property in order to cover for your debts.

3.) I am sure there is a rule somewhere, that you can not force someone to pay the tution fees. During my college days they can not even prevent you from taking the exams they can only withold your grades. Also I believe 2 weeks of classes entitles you to a substantials refund. In suggest that you check this with the DepED also please check the papers that you signed if they contained the school's refund policy.

4.)I hope that they gave you a receipt for the dining set and homne theater that they took.

5.) BTW you might consider filling for theft. since technically that is what they did. If they did not issue a receipt to you and you know where the items are. You can seek the help of the police in recovering this items just bring your purchase receipt or any proof and ownership.

6.) Lastly please seek the help of Public Attorney's Office if you can't afford a Lawyer even if you don not qualify for their services They will be more than willing to give Advice.

If my Answers does not satisfy you can try writing DEAR PAO of the philippine star.
