Hi im new here, tanong ko lang sana if yung mga loan sharks can file an estafa even themselves have no permit to operate from bangko sentral, BIR, and local business permits o kung meron man kulang? thanks po.

to revise po sir: Can a lender sue a default client even if the lender does'nt have a permit from Bangko Sentral or local permits in line with their financial business?

Yes. The lender can file legal action against the borrower, whether civil or criminal, even if the lender has no permit from the BSP and other government agencies.

In any case, it is advisable for your to raise as one of your defenses the lender's lack of permit to operate.

I have a different take on the issue of using the lack of permit to operate defense.

I think the borrower is not the proper party to raise this issue as the subject matter of the inquiry is the fact of not being able to pay debt to the plaintiff debto or in case is estafa, the fact that one defrauded the lender. Secondly, the borrower is estopped from raising the lack of license to operate on the part of the lender.

Ganito po ang situation:yun middleman ng financier ang ka-transact nmin kapag nag borrow kmi, tapos kapag nagpapasabi kami na kukuha ang sagot "wala di pa nagpapahiram dami pa nka-pila". Yun pla ang middleman ang humiram ng pera at ginamit pa 3 tao sa family namin dun sa financier. Tapos di na sya nakakabayad last Oct 2009 pa, kya syempre iba tuloy ang impression sa amin. Hanggang nagpunta na yun Financer sa amin at nagtatanong kung panu na mababayaran yun hiniram na pera. Sagot namin wala na kaming nakuha at matagal na kaming bayad. Meron ba kaming course of action against dun sa middleman? sana po ay makatulong kayo sa amin. Salamat po
