hi, I need an advice about this.
I went awol from my training which is a call center and I was still on traning (3rd week)

after a month I received a letter saying that they want me to pay P7.5k as liquidated damages for backing out from traning or failing to finish the training
and if I fail to pay the said amount they told me that they will seek legal assistance of the proper court for relief.

btw the contract i signed is not notarized
I dont know if that is really important.
will i get sued for this?

heres what exactly what the contract i signed says.

Nature of Agreement
this agreement is w/regard to the (company name). This agreements serves as a contract for both (my name)trainee and (company), by signing this document, the trainee concurs to all the provisions stated in this agreement.

(skip to the payment part)

The Trainee understands that (company) has the right to demand payment for the training cost and expenses in case the trainee terminates the contract prior to the end of the training and shall compensate the company according to the following:

1. if trainee backs out during communications training (week1), the trainee shall be liable to compensate the company agreed liquidated damages being a sum equivalent to the total expenses or two thousand five hundred pesos
2. if trainee backs out during sales and customer service training (week2),the trainee shall be liable to compensate the company agreed liquidated damages being a sum equivalend to the total expenses or five thousand pesos
3. if trainee backs out during product specifics training (week3 and onwards), the trainee shall be liable to compensate the company agreed liquidated damages being a sum equivalent to the total expenses or seven thousand five hundred pesos

Upon successful completion of the training, the trainee covenents and undertakes to serve the company for a period of 1 year. The trainee agrees with the company that if te trainee shall resign or leave the service of the company before the expiration of the contract period, then in any such case the trainee shall be liable to pay the company agreed liquidated damages being a sum equivalent to the total expenses or ten thousand pesos. if the trainee has served part of the contract period. the amount of liquidated damages shall be calculated on a proportionate basis.

Any payment which the trainee is liable to pay to the company under this agreement shall be paid within 2 weeks from the date of the written notice by the company to the trainee demanding payment. A notice sent tothe trainee's last known address by registered post shall be deemed to be sufficient.

The Company reserves the right to provide or not to provide the Trainee employment even upon successful completion of the training.


(the contract says there is no Employer-Employee Relation cause im still in traning)
