given what happened, is there anything more that you feel you should be given by the hospital? aren't they doing what they should to heal the injury? if not, how much should they pay you?

don't rush into litigation. you have four years to do so. just keep gathering evidence, but once you lawyer up, they will do the same and no longer cooperate with you.

Thank you AttyLLL for your reply.

The hospital is shouldering all the necessary expenses (follow up check up with an outside Burn Doctor and medicine costs) so we arent rushing in a lawsuit.

How about the NURSE that was on duty at that time?
Thanks in advance for your response!

you can wait for the hospital to take action regarding the nurse.

my worry is that if you take legal action against the nurse, the hospital will withdraw all the support.

for a criminal case, you only have 60 days to file a case of reckless imprudence against the nurse. you can also seek monetary damages in the max amount of P100,000 through a small claims case.

Thanks Sir!

My wife and I are planning to file a complaint against the nurse at the PRC. Would this be a wise move? We've already availed of a Medico Legal. and now we are set on contacting the PAO to seek more legal advise.

I really appreciate your advices. Thanks again!

I will keep you posted!

Good Morning AttyLLL. I would like to inquire about what is legally required by the law that the Hospital Management should shoulder with regards to the burn injury that my baby son suffered from?
How much is the "legal" settlement? We decided to get a private lawyer, is it "legal" that we include his/her professional fee in the said amount?

Thanks in advance!

you should discuss these matters with your lawyer. in settlement anything goes. you are free to demand, and they are free to reject.
