HI EVERYONE!! Im glad that there is a site like this, almost how many day na rin naman akong browsing ng different sites sa net and yet wala akong magustuhan. And now thanks God that i finally found this site which tackles different legal cases na interesting to read. Ang dami ko kasing gustong ask kaya lang siguro eto na lang muna. this is regarding PAO (Public Attorney Office), alam naman po natin lahat na ang office na toh caters indigent clientelle which cannnot afford to have a private attorneys. Kaya lang ano po ba ang rules nila regarding sa mga indigent client?? One reason po ksi kaya i ask that, is because i ask their help before, kaya lang it seems to be that they rejected to assist me because yun dapat na sasampahan ko ng kaso is nauna na humingi ng tulong sa kanila, ang pinagtatakahan ko naman po eh bakit siya ang tinulungan to the point na mas kailangan ko ng assitance nila dahil una sa lahat eh i need a lawyer kasi ang kasong isasampa ko ay VAWC (RA9262), second i consider myself indigent coz im just earning a minimum wage unlike yun taong ini-assist nila is which is earning that much (di po ba they ask for document to support yung annual income bago nila gawing client nila). Ano po ba talaga ang proseso, sabi po kasi hindi ko na "daw" kailangan ng attorney dahil ang mag-stand para sa akin eh yun fiscal na naka-assign sa kaso. medyo naguguluhan po ako. Kailangan ko pong malinawan, kasi gusto ko pong i-pursue yun kaso and yet i feel helpless. thanks po in advance..and god bless to all especially sa lahat ng nag-facilitate ng site na ito...

Usually the PAO requires you to present a certificate of indigency from the baranggay where you reside.

Pero in your case you went to the wrong office. Usually the PAO performs the function of a defense lawyer in a criminal case or sila ang abugado ng mga mahihirap na akusado sa isang kasong kriminal. In your case you are the one who will initiate a case against another person which in your circumstance is a man doing act which you believe is in violation of the VAWC law.

Ganito ang gawin mo.go to your municipal police office and ask for the women's help desk ng office na iyon. usually babae ang pulis na yun and make a report. Thereafter, magpagawa ka ng complaint-affidavit sa kanila para ma-file sa public prosecutor's office. yung public prosecutors office ang mas kilala sa tawag na Fiscal who will conduct a preliminary investigation to determine if there is a probable cause for the filing of a criminal case in court.Sa preliminary investigation i-su-subpoena yung lalaki na may kasalanan sa iyo para sagutin ang complaint affidavit na na isampa mo sa public prosecutors office..kung meron ngang ebidensya laban sa lalaki ay isasampa na ng fiscal ang kaso sa korte. Si Fiscal na rin ang magiging abugado mo pag nasampa na sa korte ang kaso mo.
