good day!

i would like to ask your advise regarding the case of my friend..he had a case under qualified theft and issued a warrant of arrest late january 2011,(no bail).though the family of my friend is willing to settle the case filed against him.

at this time, agreement is on-going on both parties,and the amount be going to settle is Php238,000.my friend's family is now ready at this time,then my friend is not around although he is currently working somewhere in batangas i just wanted to know, if the arraingment is on-going, does he appear on the court or surrender himself first and go to jail for the mean time? is that the due process to follow? to surrender him first before the arraingment happens,

Good day atty!Gusto ko lang po sana hingi ng sound advice regarding po sa case ng husband ko,ngfile po case against him ang company nya,QUALIFIED THEFT.Nakatanggap po kami ng subpoena stating na he need to give counter affidavit.Assuming na medyo malaki po ang declare nila amount kasi nga po nawawala ang chassi ng truck,pinalaki pa po ng company ang market amount,nagkataon po kasi na ang asawa ko ang dispatcher that day kaya signature nya po at responsibility nya kung bakit nawala iyon.Second,nagmanufacture po ang company ng witnesses na siya daw po(my husband) ang nagpanakaw ng chassi ng truck.It all started sa text message to his boss na ganun daw po.
Atty.nasa 550k po ang declare nila amount,ask ko lang po kung no bail po ito.Ano po kaya atty ang the best thing to do.Second hearing na po pala ito kasi po iyong first Feb 8 eh nreceived po namin ang mail Feb 9 na po.Sa ngayon po wala po kami atty. at hopeless and helpless po kami dahil we cant afford to have atty.Pwede po ba daanin sa settlement?Ang hirap po kasi atty. company po ang kalaban,and they have resources. Please advise atty for enlightenment and possible na action namin.Thanks po in advance.

Ask ko lang po, pwede po ba irevised yung affidavit of desistance into humanitarian reasons pag qualified theft? at pano po ba yun wrong spelling yung name, anna dapat ana, pag sa affidavit of desisitance po ba dapat same spelling kung ano nakafile sa kaso? pwede po bang makalabas sa kulungan because of wrong spelling yung name?

why not just correct the spelling. talk to the prosecutor. it may still be possible if no testimony has been received yet

atty. regarding this case again. my friend was already in their town, and he is willing to surrender now, but in his case was "NO BAIL" issued to him by the prosecutor, the compromised agreement on both parties will be soon,although the case is still in archived, he wanted to know if HE SURRENDER THIS MONTH OR NEXT MONTH, does it possible in order of the court to issue him a temporarily liberty?because the arraingment of the case is on going, of course he will go to jail, he wanted also to know if the arraingment is on-going , is he stay in jail for a month?or should say more than..

kasi atty. i se-settle na nila yung amount na 238,000 due to installment for atleast 1 1/2 year..kaya kahit na nasa kulungan na siya in case, makakalabas din ba siya kaagad?

the way to do it is to arrange for everything to be done in one day. you'll need to get buy in of the prosecutor and the judge. there is no precise way to do it. i would try to file a motion for setting of arraignment and approval of compromise agreement.

kelan po matatawag na no bail ang isang kasong estafa atty? paano po kung handa naman na pong magbayad ang kabilang party sa kasong estafa.. makukulong pa rin po ba ang nasasakdal? salamat po

it depends what kind of estafa and how much is involved.

willingness to pay is only part, the other party also has to be willing to accept.

May prescriptive period po ba ang pag file ng kasong qualified theft? kasi po sa kaso po ng kapatid ko, nangyari po kasi un sa kompanya mga walong taon na po ang nakakaraan. Ang akala po namin ay wala na pong kaso kc naman po matagal na yon at wala naman pong demanda, pero mga last week lang po nalaman namin nag file daw po sila ng kaso na qualified theft laban sa kapatid ko.ano po ba ang pwedeng stand namin sa kasong ito. salamat po.

I been charged of Qualified Theft and Forgery last 2007 worth 1.5M I admitted the crime and compromise to pay the said amount but they insist to have a collateral thats why I gave them the land title of my wife (pamana sa kanilang magkakapatid ng late father nya)with SPA to use the said title,and yung mga napagbentahan namin ng iba pang properties nila na pinasok sa managers check worth 1M. yung remaining napagkasunduan namin n bayaran n lang ng monthly PDC para hindi na masyado mabigat on our side.

For the 10 succeeding months was ok pero un last 5 months nagkaron ng problem yung business ni misis kaya hindi namin nabayaran nakiusap ako na wag muna nila idedeposit sa banko hanggat wala pa fund and sabi nung kausap ko they will informed me if they need to deposit na un PDC so kampante kami ni misis.

Pero one day nagulat na lang ako na may subpoena na dumating sa bahay at ang misis ko pa ang nakareceive. Nashock kami pareho at agad kong tinawagan un nagfile ng kaso sa akin pero hindi na nya ako sinasagot.

May nakapagsabi din sa akin na may kasunod na warrant of arrest na iissue. Kaya sa advice ng nakausap kong atty. kailangan ko daw mamili kung haharapin ko un kaso na nakakulong dahil NO BAIL daw un kaso ko ( tama ba? kung mali magkano yung pyansa kung sakali ) o magtatago habang kinukumpleto namin un pera para mabuo un balance ko na hindi na aabot ng 100T.

Syempre ayaw pumayag ng asawa ko na makulong ako dahil kilala un pamilya nila pero wala nakakaalam sa side nya na may kaso ako. Yun ang problema namin ngayon dahil hinahanap na ang land title ng mga kapatid nya dahil gusto na din nila makuha un parte ng lupa na paghahatian nila.

Makukuha pa po ba namin un Land Title na binigay namin sa atty ng kalaban as collateral? bakit nung nakakuha kami ng kopya ng kaso galing sa RTC Hindi nakalagay na nakapagbayad na kami ng mahigit 1.4 at 100T na lang yung kulang. Balewala na ba un 1.4 na nabigay ko? nid ko ng advice hindi ko na alam un gagawin naming magasawa hindi alam ng mga kapatid nya na ginawa namin collateral un lupa na mamanahin nila. malaking gulo ito pag nagkataon. PLEASE HELP

you should not have allowed 5 months to pass without talking to the complainant. and did you not file a compromise agreement with the court? have it manifested that you already had a compromise and you substantially performed your obligations. argue that your liability was converted into a civil obligation.

nagfile kami atty ng compromise agreement sa court pero na deny. tapos un kausap ko sa company regarding sa mga PDC hindi na nakikipagusap sa akin. Nasa RTC na un kaso ko at may warrant
na lumabas hindi sya bailable. Ngayon ang isa pa sa iniisip namin un tungkol sa titulo ng lupa na ginawa namin na collateral. May chance ba na makuha namin un? ano kaya ang mangyayari sa kaso ko. kasi ang sabi ng atty na kausap ko magtago na muna ako pag kumpleto na daw un pambayad sa kumpanya dun kami makikipagusap sa kanila. matatapos ba sa ganun un kaso ko? maraming salamat sa pagsagot.

kapag lumagpas po ba ng 10k ang nagastos na pera? ibig sabihin po ba qualified estafa na po ba yun?

May friend po akong chinarge ng qualified theft ng boarder nya. Pinaalis po kac nya ung boarder. D po nya alam na nagiwan pala ng gamit ung boarder sa boarding house. Nawala po ung mga gamit at siya pinagbintangan. May nakakita naman po na ung boarder mismo ung kumuha ng gamit nya sa boarding house pero chinarge pa rin po siya. carl, he should visit the prosecutor's office to check on the status.

jovy, i'm afraid the polygraph is not good court evidence. if this is more than 35,000, it can be 20-40 years imprisonment. i recommend you do your best to settle. but if not it is their burden to prove that your husband committed the crime.
