Violation R.A 9262

I file a case to my husband R.A 9262, should i demand how much he will give us every month or not? and i still have a right to decide if i want my daughter to borrow them or not?

you can prevent him from visiting your child and he has to file a case to enforce his rights. you can demand support based on a truthful computation of your needs.

What if i file bigamy against him he still have a right to visit or barrow my daughter?

Good evening po. Hingi po sana ako ng advice. Nagfile po ang mother ko ng RA 9262 case against our father last 2010, physically separated po ang father and mother ko for 17 years nung nag file siya. Natapos po yung prelimiary investigation and sabi ng Asst. Prosecutor na wag ng magfollow up kas matagal pa daw yung resolution kasi marami silang kasong nakapila.

Namatay ang mother ko last June 2012.

Last March 7, 2013 nakareceive kami ng resolution dated April 11, 2011 pa which reads "WHEREFORE, premises considered, it is recommended that respondent be charged with violation of Section 5 (i) of R.A. 9262. Bail recommended is PhP 24,000.00."

Ang gusto ko po malaman:

1.) Patay na nga po yung mother namin and akala po namin eh di na uusad yung kaso, pwede po ba na ako ang mag-substitute sa kaso ng mother ko against our father since nagpasa naman po ako ng Sworn Statement as witness during the preliminary investigation held on 2010?

2.) Ano po ang pwede ko gawin ngayong may resolution na?

Naliwanagan na rin po ako sa wakas kasi sa inyo na rin po nanggaling mismo na pwede pang matuloy yung kaso. Yung pulis po kasi na pinagtanungan ko ang sabi void na daw yung complaint kasi patay na mother ko. Sabi ko naman po eh buhay pa naman yung respondent, sabi naman po sa akin eh reference na lang daw po iyon para don sa new case namin na pag-extort ng pera sa tenants namin mula ng mamatay ang mother namin. Salamat po ng marami ATTY. LLL.

Good Day Atty. L., ongoing na po yung kaso ng mother ko, denied po yung Motion for Permanent Dismissal ng father ko.  Nakapag arraignment na po kami at August 28 na po yung Pre-Trial namin.

Curios lang po ako kung ano yung penalty sa RA 9262 pag na-violate yung Section 5 (i).  Na-search ko po yung RA 9262 ang nakalagay po eh:

Section 6. Penalties. - (f) Acts Falling under Section 5 (h) and and 5 (i) shall be punished by prision mayor.

Gaano po katagal yung kulong na Prision Mayor Atty. L.?

Meron po akong na-search sa internet na "Prision Mayor and Temporary disqualification- 6 years and 1 day to 12 years"

Wala po talaga ko masearch na Prision Mayor lang.

I have this friend who is staying with a foreign guy here in yet they are not officially on. And one time it happened, the foreign guy was drunk and he hit the girl and she got bruises in her left part of her face, a blood clot in her left eye. What are the things she can do about it and is it possible for a foreign guy to be deported from the Philippines?
