Hi can you help?
my brothers housing association are threatening to take my brother back to court for rent arrears stating he has broke a county court order which was actually thrown out by the judge as the housing association did not attend and do not have the court order they have stated in letters despite my brother sending them the court letter stating it was thrown out as they did not attend.
is it ellegal to demand money saying you have a court order when you dont have one and knowingly being aware you dont have one?
If so can my brother take legal action against them and are they breaking any laws and if so what are the penalties for saying they have a court order they do not have.
