you will need to clarify, who is the owner of the property and how was it initially acquired?

whose child is this? what is his relationship to the donor?

i am the legit owner of the property, i acquire the said property when i was still single it is through pag-ibig (25yrs to pay)i had a child from previous relationship. my current partner and i plans to get married but i wanted to transfer the title to my child (the child use my last name)after i fully paid the property. is this possible??? if so, what do i need to do? what if were already married but i haven't fully paid the property?? does this mean my current partner have the right to hinder me to have it titled under my child from previous relationship??

is the title already under your name?

you can also consider entering into a marriage settlement BEFORE getting married. it should be filed with your application for marriage license. in the agreement you can agree that your property regime is conjugal partnership and all your property while single will remain yours. but if you die, he and your child will share in inheriting.

you can donate it to your child now, and you can be the trustee until he is of legal age.

Hi AttyLll, may i ask if the "marriage settlement" before getting married is the "Prenuptial agreement?" Thanks, atty!

yes, prenup, antenup, marriage settlement, those are all the same.

note though, a prenup may send bad signals to the other spouse unless he/she is open minded.

Title is not yet transferred to my name, since it is under pag-ibig and 25 yrs to pay.. would it still be possible to transfer the title into my son's name even if it would take time???

talk to the seller and pag-ibig if they will allow changing the name of the buyer tO "your name in trust for your child's name". if not, then a pre-nuptial agreement is the better alternative.

if I inherit a land from my dead parents through donation mortis causa while I'm married, is that conjugal?
