Loan Paid with Bounced Cheques

Hi, hingi po ako ng advice.. Nagloan ako with issued PDCs for 3 years. Regular ako magbayad ng amortization thru cheque deposit, kaya lang last year nagkaproblema kami financially at di ko nameet yung maintaining balance ng checking acct ko kaya nagclosed yung acct.

Problem po is yung issued PDCs is under closed checking acct na at di ko n gingmit. Pero yung loan payment ko is updated thru Over the Counter na lang ginawa ko. Just to be responsible sa financial obligation ko sa bank. This year mtatapos na po yung loan amortization ko pero yung bank iniinsist na byadan ko daw yung penalties and chargers ng bounced cheques kung wlang replacement cheques. Di ko po kaya bayadan yung penalties nila kasi sobrang laki, which di ko nmn nagamit yung mga cheques. Pede po ba magfile ng criminal case (i.e. estafa) yung bank for bounced checks? kahit regularly and ahead of time ako magbayad ng loan amortization ko thru OTC. Any advise po kung ano dapat kong gawin.

May penalty po talaga ang bounced checks. Dapat nakiusap ka na lang sa kanila na wag na ideposit ang checks kasi advance ka naman pala nagbabayad ng amortization mo.

Hindi naman 'yon estafa kasi binayaran mo naman obligation mo sa kanila (loan). Pero pwede civil case ang i-file nila laban sayo to collect the penalties and charges for bounced checks.

At kung ahead of time ka naman nagbabayad, hindi na nila dapat dineposit ang checks kasi nag over the counter ka naman pala.

Try to meet with the manager, at siguro ang akuin mo lang na babayaran ay noong nahuhuli ka magbayad, pero nang on time or ahead of time ka nagbabayad, wag mo akuin ang penalties and charges.

I'll try to talk with the manager directly. Last time I tried to talk with their bank collections kaya lang nabastusan ako sa tono ng boses nya. Lahat ng pakiusap ko, sinasabi nya di daw pede (collections with astang mataas). Kelangan ko daw magbayad kung wlang replacement cheques, kaya sa inis ko pinutol ko na paguusap namin.

Yung branch manager ng bank na inapplyan ko po ba dapat ang kausapin ko? Pinapasa din po nila sa head office yung applications..
