Good day po. Ask ko lang po.Nagsampa po ako ng ejectment case sa pinsan ko. Natapos po yun sa brgy tapos po inakyat sa court. Pero sa mediation po nagkasundo na kame at nun last july 2016 umalis na po sila dun sa property. Nagtataka lang po ako kung bakit may hearing pa din po hanggang ngayon. Sinabi na po nun atty. namin sa judge na na execute na yun napagkasunduan sa mediation pero pinapa submit pa po sa akin yun original spa at may hearing pa. Pwede po ba na hindi na ako umattend ng hearing kase hindi din naman po umaatend na yun pinsan ko. Tsaka every hearing po kase may appearance fee na binabayaran. Since umalis na naman po yun pinsan ko sa property okay lang po ba na wag na ako umattend ng hearing?

Hi... I am also interested to know about this procedure to eject residential property tenants. I would have thought that all you need to do is apply for withdrawal of the case. Your lawyer only need to advise the judge that the case be dismissed... maybe the judge only needs to follow formalities...?

I was advised that there s this need to lodge a complaint to the Barrio Captain and if it cant be settled submit it to the "Lupon" The Lupon consists of people in the barrio without any legal training and no authority to obligate any party to the dispute.. and yet there are 3 consecutive weekly meetings... then a Certificate to file case will be issued and wait again 15 days before actually lodging the court case.?? This is a ludicrous circuitous procedure that simply delays justice... meanwhile the squatters are not paying rent.. further losses to the landlord.
