Hi,
I'm sorry to hear about what happened to your 12 year old daughter an the trauma she has suffered. Yes, as long your daughter and the cousin will testify in court as to what happened, as well as the other people in the house at the time of the incident (that the man was there and drank alcohol, etc.) you have a big chance of winning the case.
