qualified theft

Sana po matulungan nyo friend ko...may subpoena na po kasi dumating sa kanya.
Nangyari un kasi dinaya nila ang amount sa orig OR versus pink OR (copy ng company)Nahuli sila ng auditor nun makita may naiwan 1 orig OR ang customer at mas maliit ang nakasulat na price sa orig OR vs sa pink copy...lumalabas kaya daw lumiit ang benta dahil sa ginawa nila underreport ang sales.Ngayon lahat ng discrepancy sa inventory sa knila pinapabayad.My subpoena po this end of october...ano pong dapat nilang gawin.SAlamat po!

mayroon po bang bail sa kaso nila..nagpadala ng subpoena at computation ng discrepancy sa inventory worth 1M. Makapag-iissued po ba ng warrant sa kanilang apat?Halos nag AWOL na po yung 3 sa kanila. Isa po ay connected pa rin sa company pero ki nasuhan rin.Please help po bago magend of october.salamat po

if their modus was to falsify receipts, then i would argue that the crime committed was falsification, not qualified theft. it has a much lower penalty and is even subject to probation.

if no one points this out by attending the case and filing a counter affidavit, then the company may get away with a charge of qualified theft and it will not be bailable.

if there is no direct evidence that your friend was involved then he may have a chance of defeating it at the prosecutor level.

Oct 26 & Nov. 9 po ang nakalagay sa subpoena...so better po bang puntahan yun?Wala po kaming lawyer...pero siya po ang tinuturo nila kasi siya ang boss nila, ung 2 baka di na nagpakita,pero yung 1 connected pa at baka yun ang kunin nilang witness.Paano po namin malulusutan un witness?
Nung nabasa ko po ang subpoena, ang name na nakalagay e walang jr. Atty. jr po kasi siya, may conflict po ba ito?baka yun tatay naman niya hulihin just in case may warrant na.
Kung falsificaion po ng receipt ang pwede...paano po yung difference between prices ng items na dinaya?Baka i-point out nila yun sa court?

do not put too much importance in the absence of the jr. it's obvious who they are referring to. it is always better to appear and defend yourself, even if guilty. you can build a defense just by commenting on the evidence being presented and not have to provide any additional information that can hurt you. you can seek help from PAO or legal aid offices of law schools.
