Arresto Menor

hi im a single mom and my son is an illegitimate child hes 9 yrs old..he doesnt have a middle name and hes using my last name,. but hes biological father was able to sign in my sons birth certificate,. so is that considered as an acknowledgement from hes biological father? even if my son didnt use hes biological fathers last name? also i would like to know because my live in partner decided to legally adopt my son without us getting married,. so am i gonna have a problem with that? please help and thank you so much!
