My brother has settlement with his ex girlfriend to whom he has a child with. He has been giving 6,000 monthly for his 2 year old son however mu brother is now unemployed due to health reasons. What can we do for my brother not to be put in jail (because thats what the x girlfriend's party is saying) my mom is still employed yet she cant cover the 6,000 monthly child support they are asking for since we have utilities to pay. What can we do? Thanks in advance

make sure he is sending letters with proof of receipt of his situation. give something like 1,500 with promise to increase it once he gets a job

please don't use text spelling.

by itself, owwa does not have powers to prevent you from leaving. however, it can withhold requirements that you may need. I would say that is unlawful, but it will be best to try to stay faithful to your initial agreement.

My brother (who has a 3-year old son) has been unemployed for about 1 or 1.5years now. He does have sidelines once in a while but nothing really constant. Currently he is applying for different jobs and we are crossing our fingers he would get one. His ex-wife, on the other hand, has committed suicide and lost her job after that incident which happened last March 2013. We don’t know the exact reason is but we suspect it was about her relationship with another man who happens to have a family already. Presently, she has online store & does have indecent sidelines but she has no constant source of income also. For almost 3 years, we have no issues on child support. Even when my brother is incapable of spending for his child’s needs, my mother and I would always help him. In fact, we were the ones who took care of the hospital bills; we gave our share for the child’s birthday parties, child’s milk and diaper for two (2) weeks in a month, child’s clothing, etc. We were able to borrow the child and take care of 2 weeks a month until his mother committed suicide. Now we were emotionally stressed because the mother won’t let us see the child until we gave them child support in terms of cash. I would ask them how much was their demand (thinking it was not too much since it was only for the child’s basic need and everything should be divided in 2; Child support is a responsibility of both parents right?), they would only say just wait for the agreement etc. We can spend for the child’s need but we cannot trust her mother because of her attitude and mostly because of her vices (she habitually goes to bar and get drunk). Is it ok if the child support is not in the form of cash? (we can buy his stuffs/needs or take care of his tuition fees, etc) Also, would you think we have a chance if we pursue a legal battle for child’s custody?

support not need be in cash. you can buy groceries and pay for tuition directly.

custody is hard sell, but he will always have a right to visitation.

I am a single parent,i have 3 kids,22,17 and 10 yrs old,my ex husbabd got married last june 2013, he signed an affidavit of support stating that he'll be giving 6,000.00 peso monthly as child support but it never happen until now,it's so hard for because my kids are all studying and even if i'm here abroad still i can't provide all my children's expenses,his reason was he is just a casual employee and he doesn't have a regular job,what is the best thing for me to do? He is actually working now and their treasuser said that i cannot demand a separate check for my children,how can i get my children's support?i hope you can help me,thanks and more power.

good day !! i've having a problem lately with my x gf... threatening me she will file a case on court....  fyi i dont have a job... and lately what im giving for support for my daughter comes from my parents.... this may i given them 10k for my daughters tuition.... ( her tuition is around 16k) and its not enough she wants me to shoulder all the expenses. this june my parents cant afford to give me money to give for my daughter so i told my x gf that i'll be having money this july.... but she forcing me to give money and she even want me to pawn my lap top....  but i already told her i'll be having money this july but shes persistent and threatening me she will file a case on court.... can you advise me on my current situation.....
