back in 2008, i had a bpi credit card and i owed about 12 to 13k. i tried to pay it but when i went to the bank, the bank manager told me it was already closed (the card account), so better not pay it daw... so i did as i was told. i never got any demand letter from them. then by 2009 i changed address and phone number coz i lost my phone and had to relocate to an apartment nearer the office... so my question is, will this debt reflect on my NBI? and it's been 5 years, i now moved to davao from cebu, how will i know if i have a case?

globe postpaid - i got a postpaid phone back in 2008 and i was deliquent in 2009. got a letter (which i ignored) saying something like people of the philippines vs me and then i did not read it and threw it away. i owe them about 8k pesos. and mostly charges which i did not use because it was mostly mobile internet. it's been 4 years, how will i know if there was a case? and i did not inform them of my new address and phone number? is that defrauding them? will this reflect my NBI

Salary loan - got a salary loan in 2010 and im sure i have signed a promissory note...since i resigned from my old company and relocated back to davao, i still owe them about 21k. i got a letter from them in my davao address and they're demanding that i pay them on a certain date (this was back in 2011) and since i was unemployed at that time i just ignored the letter. i havent receive anything from them again and im still in my davao address, but i changed my number. how will i know i have a case? and will this reflect NBI clearance?

the thing is, im planning to work abroad and im scared this will all reflect in my NBI clearance. although i plan to settle these debts as soon as i have money.

please help me!!

With Globe i think hindi yan mag rereflect sa NBI mo. with the other 2 kasi it will depend if they file a case against you.

dun sa bank if verbal lang ang naging usapan ninyo with the manager hindi iyon magiging official unless its signed. anytime pwede ka mabaliktad kasi dyan.

I spoke with a friend who received the same demand letter from globe, and it did not reflect his NBI naman. So I guess, it wont affect mine too. Well the debt is actually just 8k but i refuse to pay it as most of the mobile internet charges arent mine.

my main concern though is the bank and the salary loan. i think the bank has already sold my debt to a collection agency. so it means it has written off my debt right?

gud pm po,.. may problem din po me bout sa credit card HSBC, ill be goin out of the country this coming February, matagal na po ako di nakapag bayad sa bank due to financial problem,now they have send me a e-mail naneed ko na daw settle,.. sa ngayon wala pa ako pambayad na nakalaan, mga 4 months na po siguro and only e-mail lang ang know nila bout sakin,.. ang inaalala ko po now is kung may HDO sila nilabas para sakin,.. di ko namn tatakasan ang credit ko xe few days lang namn ako dun, pls help po wat to do,.. at san po pala makikita yung watch list and HDO ng BI. thanks po

If you get an NBI clearance and they found out from your records that you have a criminal case, will you be imprisoned right there and then? Is there any way for me to find out if I have a pending case without going to the NBI?

Dear J.S.,
One of the functions of the National Bureau of Investigation (NBI) is to act as the national clearing house of criminal and other information for the benefit and use of all prosecuting and law-enforcement entities of the Philippines. To this end, the NBI stores in its database a person’s identification records such as his identifying marks, characteristics, and ownership or possession of all firearms as well as of test bullets fired therefrom. More importantly, the NBI keeps a record of all the criminal cases filed against a person (Section 1, Republic Act No. 157).

In applying for an NBI clearance, a data check is performed based on the details supplied by the applicant in his application form and the identification card(s) he submitted. If the applicant does not have any case in the NBI’s database, he will be issued a clearance with a “No Derogatory Record” remark. On the other hand, if upon proper verification it was found out that the applicant has case(s) in their database, such case(s) will be indicated in his clearance. Nevertheless, the applicant will not be arrested immediately based on the fact that his record reveals that he has a pending case. Before a person is arrested, there must be a warrant of arrest issued against him by a judge in accordance with the provisions of Section 2, Article III of the 1987 Constitution:

Sec. 2. The right of the people to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures of whatever nature and for any purpose shall be inviolable, and no search warrant or warrant of arrest shall issue except upon probable cause to be determined personally by the judge after examination under oath or affirmation of the complainant and the witnesses he may produce, and particularly describing the place to be searched and the persons or things to be seized.

There are instances, however, when a person may be validly arrested even without a warrant of arrest. These are enumerated in Section 5, Rule 113 of the Rules of Court. Hence, an applicant of an NBI clearance who was found to have pending cases in the NBI’s database will only be arrested thereat if there is a standing warrant of arrest issued in his name or if his arrest is attended to by any of the instances of a valid warrantless arrest.

As to your second question, you may still know if you have pending case(s) even if you don’t go to the NBI by going to our courts. But this process is time-consuming, not to mention, burdensome, as there are so many existing organized courts in our country. The easiest and most practical way of verifying your records remains to be the application of an NBI clearance in any of the NBI clearance offices or NBI satellite offices near you.

Just got my NBI Clearance! No derogatory record!

I just want to share this.

Last September 09, 2014. I went to UN Avenue to get an NBI Clearance. After 45 minutes of long lines and took all the process & steps except releasing.... Bang! I was tagged as "With Hit"! I was scheduled Sept 15, 2014 for releasing.

I went home and think what would be the reason. First thing in my mind was probably my overdue and unpaid balance in my Metrobank CC. I was approved by Metrobank for 100k credit limit. That was my first cc. I only used my card to purchase a plane tix worth 2k+++. Then, i paid it within a month, until my housemate (close friend) asked me to ride/used my card to purchase 2 units of phone from Lazada.com. Since, I trusted him and he was my close friend I allow him to used my card. To cut the story short, hindi ako binayaran ng friend ko even a single penny. Hanggang lumipas na ang buwan at marami pang buwan and he left our apartment. Total of 47k++ ang napurchased nya and of course galit na galit ako and hindi talaga ako magbabayad. I hunt my friend but I failed. Saklap! So it's been more than a year na ang unpaid sa credit card ko and this has been reported to metrobank. The worst thing is umabot na sa 147,000 ang unpaid ko dahil sa mga p@#ang inang interest. Now, daming letters, text & call from collection agency which bothers me. I even received a letter from a law firm....

So, yun lang ang alam ko na pwedeng maging reason why I got a HIT. I even went to this site few days to read regarding getting an NBI with unpaid credit card and has a HIT. Honestly, takot ako and kinakabahan. Pano nlang kapag mag apply ako and i have a record appearing on my NBI. Marami ako nabasa na nag inquire din cla but never went back after they got their NBI.

Dumating na ang araw Sept 15, 2014. I'm on my way to NBI UN Avenue to get my NBI Clearance... sobrang kabado. i went straight to releasing and BOOM!!!! Yung babae piniprint ang NBI ko and hindi ako sinabihan to go to Quality Room for interview.... "No Derogatory Record" ang nakalagay sa NBI ko. It was a relief!

By the way, I'm currently working with Metrobank for a payment plan that is most convenient to me.

Lesson learned, never let someone use/ride on your card! Kahit magalit man cla, even they're your relatives! Thanks!

Tips! Dahil sa new system ng NBI, when u get an NBI Clearance, always check "Renew" kung nth times mo na kukuha. When you check "New" and pang ilang beses mo na pala na kuha. You will be tagged as "With hit".
