Hi I am Emmelyn, 20 yeras of age and a newbie here. Adopted daughter ng 2 old maids, not legally pero sa birth certificate ko name ng mother ko yung nakalagay verified from nso. I coconsult ko lang po sana yung problem namin. Yung tita ko kasi pinatira ng mother ko sa vacant lot namin almost 5 years ago. Nagtayo sila ng sarili nilang bahay gamit ang sarili nilang pera sa lupa namin. Ngayon, nag-decide yung mother ko na ibenta yung house and lot. Hindi namin nasabi sa tita ko since we do not have any mode of communication and kailangan na talaga para masustain yung needs ko sa college. Ngayon gusto ng mother ko na hublian na lang sila ng 50k pero ayaw ng tita at mga pinsan ko and we there we started our argument. Nag-hyperventilate nga po ako kanina lang dahil sa sobrang sama ng loob. Pinaalis sila dito dahil sa gaspang ng ugali nila and ngayon nakikita lang nila yung damage sa kanila at sa pera nila pero yung abala na nagawa nila sa amin hindi nila naisip. From the first day na umalis sila dito, we told them na alisin na din yung bahay para mapakinabangan namin yung lupa pero hindi nila ginawa o hindi talaga nila binalak gawin. May habol ba sila sa amin? We told them na tanggalin na lang lahat ng nakatayo dun mula sa pinakamaliit na butil ng semento wag sila magtitira. I need an advice kasi nanakot pa sila na magdadala sila ng barangay. And I believe na we do not owe them anything, in fact kami pa nga yung nadamage dahil sa ginawa nila. What should I do? Can I stand regarding this issue? Or maapektuhan po nito yung right ko since adopted nga po ako? Wala po silang habol sa inyo dahil in first place, lupa ninyo 'yon!

Civil Code Article 449-451:
Art. 449. He who builds, plants or sows in bad faith on the land of another, loses what is built, planted or sown without right to indemnity.

Art. 450. The owner of the land on which anything has been built, planted or sown in bad faith may demand the demolition of the work, or that the planting or sowing be removed, in order to replace things in their former condition at the expense of the person who built, planted or sowed; or he may compel the builder or planter to pay the price of the land, and the sower the proper rent. (363a)

Art. 451. In the cases of the two preceding articles, the landowner is entitled to damages from the builder, planter or sower.


Kung kayo nga ang na-damage sa ginawa nila, sila pa ang may atraso sa inyo.

Kung ayaw talaga nila umalis, kamag-anak niyo naman sila, tama lang ang ginawa ng mother mo na pagbayarin na lang sila. Kung ayaw rin nila magbayad, kailangan nilang pasira ang bahay na tinayo nila. 'Wag po kayo matakot kung magpapa-baranggay sila, ipakita niyo sa kanila ang batas sa Civil Code natin nang maintindihan nila na sila pa nga ang may atraso po sa inyo.

salamat po sa tulong.. hindi na po namin habol na pagbayarin sila. ang problema lang po eh yung napagbentahan.. pwede po ba namin ilaban na hindi na nila pwede gibain yung bahay dahil sa babayarin na ng may-ari at nasa teritoryo naman namin yung tinayo nila?
