Hi Attorney,

Magandang Araw po!

Tungkol po ito sa pinsan ko, na involved sa aksidente.

Ang pinsan ko po na "walang lisensya" ay minamaneho nya ang kanilang motor na may side-car at lulan po nito ang kanyang kapatid. Dinala po sila sa ospital: ang pinsan ko po na nagmamaneho may sinementong daliri sa paa at ang kanyang kapatid ay gasgas, pasa at bukol sa ulo (gawa po siguro ng tumama ang ulo nya sa parte ng side-car o ng motorsiklo ng kabilang panig. Pina-x-ray po ang magkapatid at ayos naman po ang lahat.

Ang driver naman po kabilang panig lalaki na may lisensya ngunit nakainom ng alcohol (i am not sure of what level of intoxication he was when they had a crash) at may back-ride naman pong isang tao. Ang driver po at ang back ride ay parehong may dislocation of joint and/or fracture.

Noong makalawa, may pumunta po na pulis at pinapupunta po ang pinsan ko sa headquarters ng pulis para kunan ng report. Ganoon din po ang instruction sa driver ng kabilang panig. Ngunit sa ngayon po parehong driver ay hindi makalakad gawa ng kani-kanilang kundisyon.

Ang ginastos po ng pinsan ko sa ospital ay ang tiyahin ko ang sumagot.

Ngayon ang nais po ng nakainom na driver ay sagutin ng pinsan ko ang gagastusin niya at ng back-ride sa ospital.

Hindi po ba mas mabigat ang fine sa DUI?

Ayon po sa inyong point-of-view, ano po ang dapat gawin para hindi na magdemandahan at magkaprotection ng pinsan ko regarding No Driver's License VS. Driver DUI

Umaasa po ako na magkaroon ito ng kasagutan para magkaroon din ng karunungan o ideya ang mga taong makakabasa nito sa haharapin.

in makati, they perform a breathe and blood test to determine blood alcohol level. if none was performed, it will be difficult to prove intoxication.

the one driving without a license is presumed to be the one who is at fault.

Considering po na ung nakainom na driver sa police report was intoxicated, in that case, liable po ba ang pinsan ko to shoulder the other party's medical expenses?

Ikinagagalak ko po ang inyong kasagutan.
